This Form is a pour-over Will for use in California in conjunction with a Revocable Trust. The Will provides that any assets in the decedent’s personal name at the time of death are to be paid over to the Revocable Trust and administered in accordance with the terms of that trust.
This document is necessary to be certain that the decedent’s property not already titled in the name of a living trust does pass by means of a valid Will and avoids issues of intestacy, and further to assure that all of the decedent’s property will be administered in accordance with the terms of that trust, and avoid separate parallel administrations between the Will and the Revocable Trust.
The Form contains a summary of its contents which may be considered optional for use, but it is something often found useful by clients. The Form also contains a Table of Contents indicating its provisions.
