This Form is a Durable Power of Attorney. It is designed to be effective immediately upon execution, and to remain effective in the event of the signer’s disability or incapacity. This Form does not require any proof of disability of the person signing it.

The intent of the Form is to provide for the listing of a number of specific powers (such as gift-giving) which have been required by the courts or IRS to be effective, while at the same time granting broad discretion to the attorney-in-fact. It is suggested that local law/practice be consulted to see if it is helpful (or necessary) to provide citation of particular state law statutes in order to induce banks or other institutions to accept a Power of Attorney without further inquiry.
