California "Springing" Durable Power Of Attorney (8 Pages)

This Form is a California “springing” power of attorney. “Springing” means it becomes effective upon the declaration by a licensed physician that the person granting the power is incapacitated. The Form is designed for use in California but it is certainly usable in other States as well. Note that it includes a specific power in Article 4.3(b) for the Agent to make gifts.
 
This Form is an Advance Health Care Directive designed to comply with the requirements of California law. However, it may certainly be adapted for use in other States. Part I of the Form is a power of attorney for health care and appoints a person authorized to act for the signer of this document. Part II of the Form may address specific guidance regarding the nature of the health care which the signer of the document wishes to receive (or not receive).
 
This Form is a joint revocable trust for spouses prepared to comply with California law. This Form is a pour-over Will for use in California in conjunction with a Revocable Trust. The Will provides that any assets in the decedent’s personal name at the time of death are to be paid over to the Revocable Trust and administered in accordance with the terms of that trust.

He is presently serving as an adjunct professor of law in the Graduate Tax Program (LLM) of the University of Alabama, and has served as an adjunct professor of law at Seton Hall and Rutgers University law schools. Mr. Siegel holds a bachelor’s degree from Georgetown University (magna cum laude, phi beta kappa), a juris doctor from Harvard Law School and an LLM in taxation from New York University Law School.
